Examining Important Factors, Child Support Guidelines
The states of Kansas and Missouri have elaborate equations to come up with an accurate child support amount in divorce and dissolution cases. While the factors involved in determining child support payments may seem intricate or based upon the collection of a lot of financial data, what it really comes down to is this: each parent’s income and the amount of parenting time each parent spends with the children. This is what the court is going to look at and it is what I look at.
Of course, considerations such as daycare, healthcare, and who holds primary residential custody, all factor into the final decision.
Getting Down to Essentials
In Kansas, the court will usually give a maintenance amount to the primary residence custodian of 20% of the difference between the gross incomes of the parents (click here for an estimation using a Kansas Child Support Calculator or Missouri Child Support Calculator). There can be exceptions in each case but this is a reasonable expectation based upon past experience. The legal requirement for the allocation of maintenance in both Kansas and Missouri is one spouse's need and the other spouse's ability to pay. One of the things I have learned in my 25 years of family law experience is that you have to examine the important issues related to your children.
When I work with my clients, I examine their lifestyle, the lifestyle of their children, the interaction between children and parents and any costs that must be factored in (music lessons for example, should be a special need if your son or daughter plays an instrument particularly well and wishes to continue their study). However, most judges read child support statutes narrowly. I am always fighting to expand the Court's views as to what types of support or special needs should be considered. I make sure that the benefits your children have been accustomed to are preserved through adequate support.
